1. DEFINITIONS AND INTERPRETATION
1.1 "Service" means the EXagon Eye™ intelligence platform including all reporting capabilities, analytical engines, interfaces, documentation, and any updates or modifications thereto, powered by TITAN Engine©.
1.2 "Intelligence Reports" means the proprietary analytical outputs generated by the Service based on Client requests and parameters.
1.3 "Session Persistence" means the cryptographic process wherein the Service maintains authenticated access via SESSION UUID tokens for defined periods: 72 hours for Enterprise clients, 24 hours for Government/Military clients.
1.4 "Service Tier" refers to the classification of Client access: Enterprise (commercial entities) or Government/Military (state entities, ministries, institutions).
1.5 "Operational Territory" refers to countries where the Service may legally be accessed, explicitly excluding all prohibited jurisdictions as defined in Section 8.
2. SERVICE GRANT AND RESTRICTIONS
2.1 Limited Service Grant. Subject to full compliance with all terms herein, Horos-18b grants Client a limited, revocable, non-exclusive right to access and use the Service solely for internal, lawful intelligence gathering purposes. This access is strictly personal to the Client and is not transferable, assignable, or sublicensable under any circumstances.
2.2 Account-Based Access. Service access is cryptographically bound to the specific Client account and organizational credentials verified during onboarding. Any attempt to transfer, share, or provide unauthorized access constitutes a material breach of this Agreement and immediate termination of all rights.
2.3 Strict Prohibitions. Client shall not, and shall not permit any third party to: (a) copy, reproduce, modify, adapt, or create derivative works of any Intelligence Reports or Service components; (b) reverse engineer, decompile, disassemble, or otherwise attempt to derive the proprietary methodologies of TITAN Engine©; (c) remove, alter, or obscure any proprietary notices; (d) use the Service for any illegal, unauthorized, or unethical purposes; (e) attempt to circumvent security measures, access controls, or operational limitations; (f) share, distribute, loan, lease, or otherwise transfer access to the Service or Intelligence Reports.
2.4 Secrecy and Confidentiality. Client acknowledges that the Service, Intelligence Reports, and underlying methodologies contain trade secrets and proprietary information of Horos-18b. Client agrees to maintain absolute secrecy regarding the Service's capabilities, analytical methods, source methodologies, and any intelligence gained through its use.
3. OWNERSHIP AND INTELLECTUAL PROPERTY
3.1 Exclusive Ownership. Horos-18b is and shall remain the sole and exclusive owner of all right, title, and interest in and to the Service, TITAN Engine©, Intelligence Reports methodologies, and all intellectual property rights therein. Nothing herein shall be construed as transferring any ownership rights to Client.
3.2 Report Usage Rights. Client acquires a limited license to use Intelligence Reports internally within their organization for the specific purposes for which they were procured. No redistribution, publication, or commercial exploitation of Reports is permitted without express written authorization.
3.3 No Implied Rights. Client acknowledges that all rights not expressly granted herein are reserved by Horos-18b. Client acquires no rights to patents, copyrights, trade secrets, trademarks, or any other proprietary rights of Horos-18b.
4. SERVICE ACCESS AND OPERATION
4.1 Automated Onboarding. Client access is established through our automated registration system via encrypted Telegram bot. This process collects necessary verification data as detailed in our Privacy Policy.
4.2 Session Management. Service access utilizes SESSION UUID persistence: 72-hour sessions for Enterprise clients, 24-hour sessions for Government/Military clients. Sessions automatically terminate upon expiry and require re-authentication.
4.3 Automated Ordering System. Intelligence Report requests are processed through our automated ordering system. Clients submit parameters through the platform interface, and reports are delivered through established secure channels.
4.4 Service Availability. Horos-18b makes commercially reasonable efforts to maintain Service availability but does not guarantee uninterrupted access. Scheduled maintenance and unscheduled downtime may occur without prior notice.
5. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
5.1 "AS IS" Basis. THE SERVICE AND INTELLIGENCE REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR OPERATIONAL CONTINUITY.
5.2 Intelligence Accuracy. While TITAN Engine© employs advanced analytical methodologies, Horos-18b does not guarantee the accuracy, completeness, or timeliness of Intelligence Reports. Client assumes all responsibility for verification and due diligence before acting upon any intelligence provided.
5.3 Absolute Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOROS-18B SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR OPERATIONAL CAPABILITY, ARISING FROM OR RELATED TO THE USE OR INABILITY TO USE THE SERVICE OR RELIANCE ON INTELLIGENCE REPORTS.
5.4 User Responsibility. Client acknowledges and agrees that: (a) Intelligence Reports are advisory in nature; (b) Client assumes all legal, regulatory, and operational responsibility for decisions made based on Reports; (c) Horos-18b is not responsible for outcomes resulting from Client actions taken based on intelligence provided.
5.5 Indemnification. Client agrees to indemnify, defend, and hold harmless Horos-18b, its affiliates, officers, and employees from any claims, damages, losses, or expenses arising from Client's use of the Service, Intelligence Reports, or violation of this Agreement.
6. PAYMENT AND REFUND POLICY
6.1 Payment Terms. Access to the Service requires prepayment through cryptocurrency as specified during onboarding. All payments are final and non-refundable once Service access is granted.
6.2 No Refunds. DUE TO THE NATURE OF THE SERVICE AS AN INTELLIGENCE PLATFORM WITH IMMEDIATE ANALYTICAL CAPABILITIES, NO REFUNDS, RETURNS, OR EXCHANGES ARE PERMITTED UNDER ANY CIRCUMSTANCES ONCE INTELLIGENCE GENERATION HAS COMMENCED.
6.3 Service Tiers. Different pricing structures apply to Enterprise versus Government/Military service tiers as detailed during the onboarding process.
7. PRIVACY AND DATA PRACTICES
7.1 Minimal Data Collection. The Service operates on a privacy-by-design principle, collecting only data necessary for Client verification, service delivery, and report generation as detailed in our Privacy Policy.
7.2 Commercial Secrecy. All Client data provided to Horos-18b is protected as commercial and trade secrets. We do not sell, share, or analyze Client data for purposes beyond service delivery.
7.3 Data Retention. Client data is retained only as necessary for service delivery. Specific retention periods are detailed in our Privacy Policy, including session persistence durations and post-termination data handling.
7.4 Geographic Data Policy. As a Global South entity serving Global South clients exclusively, our data practices comply with applicable laws in our jurisdiction of operation while maintaining higher internal security standards.

8. GEOGRAPHIC RESTRICTIONS AND COMPLIANCE
8.1 Not supported Jurisdictions except jurisdictions approved under section 8.2 and 8.2b. The Service is explicitly not supported in, or for entities located in, or operating in, the following jurisdictions:
- All NATO Member States: Albania, Belgium, Bulgaria, Canada, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Italy, Latvia, Lithuania, Luxembourg, Montenegro, Netherlands, North Macedonia, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom, United States.
- All European Union Member States.
- All Schengen Area Countries.
- Five Eyes Alliance: United States, United Kingdom, Canada, Australia, New Zealand.
- Additional unsupported: Japan, South Korea, Taiwan, Belarus, Ukraine.
- French African Territories and allies or under influence (ECOWAS and other) except jurisdictions approved under section 8.2 and 8.2b: Senegal, Ivory Coast, Morocco, Tunisia, Benin, Togo, Equatorial Guinea, Guinea, Guinea-Bissau, Mauritania, Angola, Cameroon, Congo.
- US Allied States or under influence except jurisdictions approved under section 8.2: Saudi Arabia, Kuwait, Qatar, Oman, Botswana, Djibouti, Turks and Caicos Islands, Trinidad and Tobago.
- Problematic Regimes: Israel, Argentina, Somaliland, Chile, Uruguay, Sudan, Paraguay, Bolivia, Peru, Ecuador, Colombia, Venezuela, Syria, Cuba, Honduras.
8.2 Approved Jurisdictions - ENTERPRISE ONLY. The Service may only be accessed from and by corporate entities located in the following approved jurisdictions:
- Asia: China, Russia, Iran, Türkiye, Vietnam, Thailand, Malaysia, Laos, Cambodia, Mongolia, Nepal, Maldives, Brunei, Jordan, Bahrain, United Arab Emirates, Singapore, Indonesia, Philippines, Lebanon (only by special dispensation), Yemen (only by special dispensation), Bangladesh (only by special dispensation), Pakistan, Sri Lanka, Kazakhstan, Uzbekistan, India.
- Africa:
- North Africa: Egypt, Algeria.
- West Africa: AES countries (Burkina Faso, Mali, Niger), Ghana, Nigeria (only by special dispensation), Sierra Leone, Cabo Verde.
- Central Africa: DRC, Chad (only by special dispensation), Central Africa, Burundi (only by special dispensation), Rwanda.
- East Africa: Kenya, Ethiopia, Eritrea, South Sudan (only by special dispensation), Somalia, Tanzania, Uganda, Malawi, Mozambique, Madagascar, Comoros, Mauritius, Seychelles.

8.2b Approved Jurisdictions - SOVEREIGN/INSTITUTION ONLY. The Service may only be accessed from and by sovereign entities located in the following approved jurisdictions:
- Asia: Vietnam, Thailand, Malaysia, Laos, Maldives, Bahrain, Philippines, Sri Lanka, Kazakhstan.
- Africa:
- North Africa: Egypt, Algeria.
- West Africa: AES countries (Burkina Faso, Mali, Niger).
- Central Africa: DRC, Rwanda.
- East Africa: Ethiopia, Eritrea, Somalia, Malawi, Mozambique, Madagascar, Mauritius, Seychelles.
- Southern Africa: South Africa, Namibia, Zambia, Zimbabwe.
- Americas: Brazil, Mexico, El Salvador, Haiti, Panama, Belize.
- Caribbean & Atlantic: CARICOM countries, Curaçao, Bahamas.
- Pacific Islands: Marshall Islands, Cook Islands, Vanuatu, Fiji, Papua New Guinea, Guam, Kiribati, Timor-Leste, Niue, Tuvalu, Palau.
- Neutral Jurisdictions: Nauru.
Note: Access from jurisdictions marked "(only by special dispensation)" requires prior written authorization from the Service Provider.
8.3 Geographic Compliance. Client represents and warrants that they are not located in, under control of, or a national/resident of any prohibited jurisdiction listed in Section 8.1. Client further certifies that all operations utilizing the Service will occur from approved jurisdictions.8.4 Compliance Responsibility. Client assumes full responsibility for ensuring compliance with all applicable laws, regulations, and restrictions in their jurisdiction. Any access from or on behalf of prohibited jurisdictions constitutes immediate breach of this Agreement.
9. VERIFICATION AND ENFORCEMENT
9.1 Truthful Declaration Mandate. All information provided during onboarding must be truthful, accurate, and complete. Deliberate misrepresentation constitutes material breach and fraud.
9.2 Verification Capabilities. Horos-18b Systems maintains advanced technical means to verify:
- Document falsification, forgery and use of forged documents to register with our services
- Infrastructure misrepresentation
- Jurisdictional non-compliance
- Organizational category falsification
9.3 Enforcement Consequences. Any attempt to circumvent Section 8.1 Geographic Restrictions or provide false information will result in:
- IMMEDIATE TERMINATION: Permanent revocation of EXagon Eye™ platform access without refund
- LEGAL ACTION: Civil and criminal proceedings in favorable jurisdictions
- DAMAGES: Liability for all costs, including technical countermeasures and legal expenses
- GLOBAL BLACKLISTING: Permanent prohibition from all Horos-18b Systems products and services
9.4 Proprietary Monitoring Technology. Horos-18b Systems actively employs a highly powerful variant of TITAN Engine© technology for security monitoring and verification purposes. False declarations will be detected rapidly through automated and manual verification processes.
10. TERMINATION AND SUSPENSION
10.1 Automatic Termination. This Agreement automatically terminates upon: (a) violation of geographic restrictions; (b) provision of false information during onboarding; (c) any attempt to breach security measures; (d) violation of any term herein.
10.2 Immediate Suspension. Horos-18b reserves the right to immediately suspend or terminate access without notice if: (a) Client violates geographic restrictions; (b) Client uses the Service for illegal purposes; (c) Client attempts to reverse engineer or compromise the Service; (d) Client discloses proprietary information.
10.3 Effect of Termination. Upon termination, all rights granted herein immediately cease. Client must immediately cease all use of the Service. No data recovery or transition assistance is provided.
11. MISCELLANEOUS PROVISIONS
11.1 Amendments. Horos-18b reserves the unilateral right to modify, amend, or update these Terms at any time without prior notice. Continued use after changes constitutes acceptance of modified terms.
11.2 Severability. If any provision herein is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11.3 Entire Agreement. This document constitutes the entire agreement between parties regarding the Service and supersedes all prior communications, representations, or agreements.
11.4 Governing Law. This Agreement shall be governed by the laws of the jurisdiction where Horos-18b is established, without regard to conflict of law principles.
11.5 Force Majeure. Horos-18b shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control.
11.6 No Waiver. Failure to enforce any provision shall not constitute a waiver of that provision or any other provision herein.
12. FINAL ACKNOWLEDGEMENT
By proceeding with registration and use of the Service, you affirm under penalty of perjury that all information provided is truthful and accurate, and you accept full liability for any misrepresentation.
